Welcome to yueofficial.com (the “Site”), operated by YUÈ (“we,” “us,” or “our”). By accessing or using the Site, browsing our portfolio, contacting us, or purchasing a look or a pattern, you agree to these Terms of Service (“Terms”). If you do not agree, please do not use the Site.

1. USE OF THE SITE

You agree to the use Site only for lawful purposes and in a way that does not infringe the rights of others or restrict their use of the Site. You must not attempt to gain unauthorized access to the Site, interfere with its operation, introduce malicious code, or use automated tools to scrape or copy its content.

You must be at least 18 years old, or the age of majority where you live, to make a purchase. If you are younger, you may only purchase with the involvement of a parent or guardian.

2. INTELLECTUAL PROPERTY

Our content. All content on the Site, including designs, photographs, illustrations, text, logos, patterns, and layout, is owned by us or our licensors and is protected by copyright, trademark, and other intellectual property laws. Portfolio images and designs are shown for viewing purposes only. You may not copy, reproduce, modify, distribute, or use them without our prior written permission.

Feedback. If you send us ideas or suggestions, we may use them without obligation to you.

3. PATTERNS AND LICENSE

When you purchase a pattern, you receive a limited, non-exclusive, non-transferable license to use it according to these Terms. Ownership of the pattern and all rights in it remain with us.

You may: (a) Print and use the pattern to make garments or items for yourself, your family, or as gifts, (b) Make copies of the pattern for your own personal use, such as reprinting a damaged copy.

You may not: (a) Share, resell, redistribute, upload, or give away the pattern file or printed copies, in whole or in part, whether free or for payment, (b) Claim the pattern or its design as your own, (c) Use the pattern, our designs, or our name to produce items at scale or for mass production without a written license from us.

We may suspend or terminate your access to a pattern, without refund, if you violate this license.

4. ORDERS AND PAYMENT

All prices are listed in U.S. dollars and may change at any time without notice. Payment is processed by third-party payment processors. By placing an order, you confirm that you are authorized to use the payment method provided. We may refuse or cancel any order, for example due to suspected fraud, pricing errors, or technical problems. If we cancel an order after payment, we will issue a refund. You are responsible for any applicable taxes.

5. DIGITAL DELIVERY

Digital patterns are delivered electronically, typically by download link after payment is confirmed. It is your responsibility to provide a correct email address and to download and save your files. If you have trouble accessing your purchase, contact us and we will help.

6. REFUNDS AND RETURNS

Subject to the consumer rights described at the end of this Section 6 for customers in the EU, EEA, and UK, and to any rights you have under applicable law: because digital patterns can be downloaded and copied immediately, all sales of digital patterns are final and non-refundable. If you received a corrupted or incorrect file, or were charged in error, contact us within 14 days of purchase and we will fix the problem or issue a refund at our discretion.

Consumers in the EU, EEA, and UK

If you are a consumer located in the European Union, European Economic Area, or United Kingdom, the following applies and takes priority over anything inconsistent in this Section 6. Nothing in these Terms affects your mandatory statutory rights.

Right to cancel (14 days). You generally have the right to cancel an order within 14 days, without giving a reason. For physical items, the 14 days run from the day out (or someone you nominate) receive the goods. To cancel, email us at yuedesignsfw@gmail.com with a clear statement of your decision, or use the model cancellation form if you prefer. We will refund the price paid, including standard delivery costs, within 14 days of receiving your cancellation (and, for physical items, once we receive the goods back or proof you’ve sent them). You are responsible for the cost of returning physical items unless they were faulty or not as described, and we may reduce your refund if the items have lost value through handling beyond what is needed to inspect them.

Digital patterns and loss of the right to cancel. Digital patterns are supplied as downloadable files rather than on a physical medium. By placing an order for a digital pattern, you request that we begin supplying it immediately, and you acknowledge that once the download link has been made available to you, you lose your right to cancel. We will ask you to confirm this at checkout before your purchase is completed.

Faulty or misdescribed digital patterns. The loss of your right to cancel does not affect your rights if a digital pattern is faulty, corrupted, not as described, or does not work as it should. In that case, you are entitled to have it brought into conformity (for example, a corrected or replacement file) and, if that is not possible or we fail to do so within a reasonable time, to a price reduction or a refund, as provided by the laws that apply to you, including the EU Digital Content Directive and, in the UK, the Consumer Rights Act 2015.

Faulty physical items. If you receive a physical item that is faulty or not as described, you have the legal remedies available to you under your local consumer law, including repair, replacement, price reduction, or refund.

Mandatory consumer protections. If you are a consumer, you are entitled to the protection of the mandatory consumer laws of the country where you live. Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot be excluded or limited by law.

7. SIZING, FIT, AND RESULTS

Patterns are provided as design tools. Fit, sizing, fabric choice, skill level, and sewing techniques vary, and we cannot guarantee that a finished garment will fit you or look like the photographed sample. Please review the size chart, fabric recommendations, and instructions before purchasing and before cutting. We are not responsible for fabric, materials, or time spent on projects made from our patterns.

8. CONTACT FORM AND COMMUNICATIONS

When you contact us through the Site, you agree to provide accurate information, including your name and email address. We will use that information to respond to you as described in our Privacy Policy. Submitting a message does not create a business, employment, or design-services relationship, and we are not obligated to respond to every inquiry. Please do not send confidential information or unsolicited design submissions through the form.

9. THIRD-PARTY LINKS AND SERVICES

The Site may link to third-party websites and services, including social media and payment providers. We do not control and are not responsible for their content, policies, or practices.

10. DISCLAIMER OF WARRANTIES

The Site and all content and products are provided “as is” and “as available,” without warranties of any kind, either express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components.

11. LIMITATION OF LIABILITY

To the fullest extent permitted by law, YUÈ and its owners, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from your use of the Site or our patterns. Our total liability for any claim relating to the Site or a purchase will not exceed the amount you paid us for the product at issue.

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

12. INDEMNIFICATION

You agree to indemnify and hold harmless YUÈ and its owners, employees, and contractors from any claims, damages, or expenses (including reasonable attorneys’ fees) arising from your violation of these Terms or misuse of the Site or patterns.

13. GOVERNING LAW

These Terms are governed by the laws of the State of Illinois, without regard to conflict of law principles. Any dispute arising from these Therms or your use of the Site will be resolved in the state or federal courts located in Cook County, Illinois, and you consent to their jurisdiction. If you are a consumer in the EU, EEA, or UK, this does not deprive you of the mandatory consumer protections of the country where you live, and you may also bring a claim in the courts of that country.

14. CHANGES TO THESE TERMS

We may update these Terms from time to time. Changes take effect when posted on the Site, and the “Last updated” date will be revised. Your continued use of the Site after changes are posted means you accept the new Terms.
